Welcome to Talkify, a platform that allows users to connect, interact, and generate revenue through their conversations, advice, and interactions. By accessing Talkify, you accept these Terms of Service (TOS). If you do not agree with these terms, please do not use the platform.

2. Definitions

• User: Any person who accesses the Talkify platform.
• Service Provider: On Talkify, users become "Talkeurs" or "Talkers," offering rich and varied services, advice, and interactions for a unique and friendly exchange experience.
• Client: User requesting or receiving services on the platform.
• Platform: The Talkify application and website.
• User/Expert Transaction: Any video call or interaction between an Expert and a Client, conducted via the platform and involving financial compensation.

3. Access and Registration

3.1. Access to Talkify is restricted to individuals at least 18 years of age. By accessing or using Talkify, you guarantee that you meet this age requirement.

3.2. To use the platform, you must create an account by providing accurate, current, and complete information.

3.3. You are responsible for the confidentiality of your login credentials and any activity on your account.

4. Platform Operation

4.1. Services Offered: Users can offer or receive advice and interactions for compensation determined by the Expert.

4.2. Monetization: Revenues are shared between the Expert and Talkify according to a pre-established percentage. Commission details are available on the pricing page.

4.3. Transactions: Payments are processed through secure third-party partners. Talkify is not responsible for issues related to payment processors.

5. Acceptance of Terms

5.1. By using the Talkify platform, you agree to be bound by these TOS as well as other complementary policies or conditions, such as:

• The privacy policy,
• Acceptable use rules,
• Referral program terms (if applicable).

5.2. If you do not accept these conditions, you must not use the Talkify platform.

6. User Obligations

6.1. You agree to provide truthful and up-to-date information during registration and to maintain its accuracy.

6.2. You agree to respect the copyright and intellectual property rights of other users and the platform.

6.3. As an Expert, you consent to provide quality services that conform to your descriptions. Any inappropriate or explicit requests may result in immediate suspension of your account.

7. Intellectual Property

7.1. All content available on Talkify (texts, graphics, logos) is the exclusive property of Talkify or its partners and is protected by intellectual property laws.

7.2. You retain rights to the content you publish on the platform, but you grant Talkify a worldwide, non-exclusive, and free license to use, reproduce, and distribute this content as part of service provision.

8. Limitation of Liability

8.1. Talkify acts solely as an intermediary and cannot be held responsible for the acts or omissions of Users.

8.2. Talkify does not guarantee uninterrupted availability of services or the absence of technical errors.

8.3. Any data loss or service interruption caused by third parties or technical problems is outside Talkify's scope of responsibility.

9. Usage Restrictions

9.1. You may not use Talkify for illegal, immoral activities or those not in compliance with the TOS.

9.2. You must not attempt to access unauthorized data or systems on the platform.

9.3. Any violation of these restrictions may result in the suspension or termination of your account.

10. Modifications to the TOS

Talkify reserves the right to modify these TOS at any time, particularly to comply with regulatory changes or to meet business needs. Modifications will take effect immediately after their publication.

11. Disputes and Arbitration

11.1. In case of disagreement, the parties commit to dialogue in a spirit of collaboration to find an amicable and equitable solution.

11.2. If no agreement is reached, the dispute will be resolved in accordance with the laws in force in the user's country of residence, with the aim of preserving a respectful and serene framework.
